The difference in the decisions between this and the Fourth Department have been resolved by the Court of Appeals in Hubbard v. Hubbard (228 N. Y. 81). Motion denied, with ten dollars costs. Present—Clarke, P. J., Laughlin, Dowling, Page and Greenbaum, JJ.
