People v. Bosch (223 A.D. 771, 1928)

Judgment of conviction of the Court of Special Sessions, Borough of Queens, reversed upon the facts, information dismissed and defendant discharged from custody. We are of opinion that the evidence adduced by the People was insufficient to justify the conviction of defendant for a violation of section 290, subdivision 3, of the Highway Law. (People v. Weaver, 188 App. Div. 395.) Lazansky, P. J., Rich, Hagarty, Seeger and Carswell, JJ., concur. .
