J., Martin, O’Malley, Townley and Glennon, JJ.; Martin, J., dissents and votes to reverse and grant a new trial on the counterclaim of the defendant, for the reason that the charges set forth therein were proved, and, therefore, the judgment in favor of the husband was against the weight of the evidence.
