Vlahakis v. Sharf (277 A.D.2d 1052, 1950)

In an action to recover for damages alleged to have been sustained by plaintiffs, through the furnishing of defective material, under a contract to furnish and install soda fountain equipment, judgment, entered upon the dismissal of the complaint, on motion of defendant, at the conclusion of plaintiffs’ case, unanimously affirmed, with costs.
