Upon the remittitur of the Court of Appeals, dated November 30, 1961, the order of this court disbarring respondent (12 A D 2d 650) is set aside, and the petition is dismissed. Nolan, P. J., Beldock, Ughetta, Christ and Pette, JJ., concur.
