Field, J., delivered the opinion of the Court Terry, C. J., concurring. This case raises the same questions which were considered and decided upon a similar state of facts, in Stewart v. Scannell, (8 Cal., 80.) Upon the authority of that case, the judgment of the Court below is affirmed.
