Terry, C. J., concurring.

1. The complaint in this case is sufficient.

2. The witness Morrissey had no interest in the event of the suit, having ceased to be a stockholder before the suit was brought.

3. The damages were not excessive.

Judgment affirmed, with ten per cent, damages.
