ORDER Upon the vote of a majority of nonrecused regular active judges of this court, it is ordered that this case be reheard by the en banc court pursuant to Circuit Rule 35-3. The three-judge panel opinion, County of Lewis v. Allen and Nez Perce Tribe, 141 F.3d 1385 (9th Cir.1998), amended May 5, 1998 and July 24, 1998, is withdrawn.
