This is an appeal from, a decree rendered in a suit for the foreclosure of a trust deed, in which appellant was complainant and Andrew Peterson, trustee, G-eorge P. Bay, successor in trust, Annie Serum, Helena Serum, Martin H. Serum and others, defendants.

The trust deed was executed by Andrew H. Serum and Annie Serum, his wife, December 5, 1891, of certain premises therein described, to secure the payment of a promissory note of the same date, for the sum of $5,000, with interest at six and one-half per cent per annum, pajmble semi-annually at the banking house 'of Peterson
