McCulloch, J.
This was a suit commenced before a justice of the peace by appellee against appellants as co-partners, to recover a penalty provided by the city ordinances for a failure to take out a license, as provided by section 13 of article 1, of chapter entitled Licenses, passed on the 20th day of September, 1875.
The suit having been carried by appeal into the circuit court, a trial was there had before the court without a jury, and judgment rendered against appellants for the sum of ten dollars, to reverse which judgment an appeal was taken to this court.
