It is ordered and adjudged that the judgment of the said Court of Appeals be, and the same is hereby, affirmed on authority of Miller, Pros. Atty., v. Lakewood Housing Co., 125 Ohio St., 152, third proposition of syllabus.
Judgment affirmed.
