dissenting.

I would reverse the summary judgment because of the favorable inferences arising out of appellant’s deposition. While not factually identical to the present case, Grizzard v. Colonial Stores, Inc., 330 So.2d 768 (Fla. 1st DCA 1976), provides, in my view, support for reversal.
