PER CURIAM.

The order appealed from is affirmed. The said affirmance is without prejudice to the appellant seeking to have an evidentiary hearing as suggested by the trial court. See Merrill Lynch, Pierce, Fenner & Smith, Inc. v. National Bank of Melbourne & Trust Co., 238 So.2d 665 (Fla. 4th DCA 1970).

Affirmed.
