PER CURIAM.
We treat the instant appeal as a petition for certiorari. See Chiusolo v. Kennedy, 589 So.2d 420 (Fla. 5th DCA 1991), approved in part; quashed in part, 614 So.2d 491 (Fla. 1993). ■ We find the issue posed herein to be moot, and, accordingly, deny the petition.
