Affirmed. See Applegate v. Barnett Bank of Tallahassee, 377 So.2d 1150, 1152 (Fla.1979). As to the other issue we affirm based on DiStefano Constr., Inc. v. Fidelity & Deposit Co. of Md., 597 So.2d 248, 250 (Fla.1992).
