MORROW, P. J. The offense is robbery with firearms; punishment fixed at confinement in the penitentiary for a period of 50 years. By the affidavit of the sheriff of Erath county, it has been made to appear that the appellant lias escaped from custody and remained at large for more than ten days; that he has not voluntarily returned, but is still at large. By reason of his escape, the appeal is dismissed.
