PLEASANTS, C. J.
This is a suit by the appellee against the appellants, who are the county judge and members of the commissioners’ court of Bur-leson county, to establish his claim against the county and require its allowance by defendants for the sum of $1,044 fees alleged to be due him for services rendered by him as district clerk in a number of suits for delinquent taxes brought by the county, which fees were adjudged in favor of appellee against the county in the suits in which they accrued.
The defendants answered by excepting to the petition on the ground that the fees claimed by appellee accrued to him under article 7332 of our Revised Statutes (1925) in suits brought in the name of the state of Texas against the numerous parties named in plaintiff’s petition to recover delinquent tax
