GARRETT, Chief Justice.
Action to recover damages for personal injuries, brought by the appellee in the District Court of Fort Bend County against the appellant. This is the second appeal; the first will be found reported in 70 Texas, 67.
Plaintiff alleged, that he received the injuries on May 9,1885, while a passenger on defendant’s line of railroad going from Rosenberg to Alley-ton, at Randon, an intermediate station, where he had got off the cars on to the platform to deliver a message with which he was charged to some one there; that while he was attempting to get aboard of the train again, he was thrown down by reason of the negligence of defendant’s servants who were operating the train, in suddenly and violently starting the train without the usual signals; and his left foot and ankle were so crushed and broken that it became necessary to have his leg amputated below the knee. He also alleged, that prior to the injuries he was engaged in the business and occupation of a stockman, by which he earned the sum of 81500 annually; that in consequence' of his injuries he had been crippled for life, and wholly disabled from ever pursuing his occupation, which was the only business for which he
